Apartment and condo complex owners would need to jump through hoops to bring a civil action for construction defects under an ordinance City Council is considering adopting.
City Council is being briefed today about a proposal ordinance that would, among other things, require condo associations get approval from a majority of unit owners before suing a building or developer for defects.
The measure is being seen by some as another deferential move to builders and developers, because the measure also would require boards of multi-owner complexes to give notice to all owners of the potential costs of litigation and fall out if the lawsuit fails.
The Council won't take action today, and it's unclear when it would be proposed for a vote. Read the proposed measure here:
